It is legal to participate in online sports betting in West Virginia, which was one of the first states to push for legal sports betting. The process started back in March 2018 when Bill 415 was enacted, which went on to facilitate the launch of retail sports betting in August of the same year, with online sportsbooks becoming legal a year later.

In order to legally place an online sports bet in West Virginia, bettors must be 21 years of age or over and have a registered account with one of the state’s nine legal sportsbooks.  

Sports Betting Winnings are Taxable in West Virginia

West Virginia’s nine approved sportsbooks have to pay tax at a flat rate of 10% of their adjusted gross sports betting revenue, which they usually recoup from their customers via either reduced odds or adjusted winnings.

For individual bettors, income from winnings from online sportsbooks is taxable at federal level, and the Internal Revenue Service (IRS) requires each person to report and pay tax on all of their gambling winnings, including amounts won through online sports betting. These sums must be reported as “Other Income” on IRS Form 1040, with the rate an individual pays being based upon their annual earnings.

For individuals, tax is also payable on winnings at a state level at a flat rate of 6.5%.

Who Regulates West Virginia Sports Betting?

The West Virginia Lottery Commission is the body responsible for overseeing and regulating all forms of gaming and gambling in the state, including sports betting.
